SmartLens Technologies, Inc. (“SmartLens,” “we,” or “us”) offers computer vision, natural language processing and other solutions built upon machine learning and artificial intelligence technologies. To provide the Services defined in the Terms of Use [https://smartlens.ai/terms], SmartLens collects certain data from you (“User Content”).

We take privacy and security very seriously. Other than for payment processing, under no circumstances will your User Content be sold, transmitted, or shared with a third party unless we are required to respond to subpoenas, court orders, or legal process, to establish or exercise our legal rights or defend against legal claims. Payment processing is performed by Stripe, Inc. Please see Stripe’s terms of service and privacy policy [https://stripe.com/legal] for information on its use and storage of User Content.

What User Content does SmartLens collect?

Name, email address, billing details, and other account information. When you register for an account, update your account information, or add a payment method, we collect and store this information. We do not, however, store full credit card numbers or personal account numbers. Payment processing is performed by Stripe, Inc. Please see Stripe’s terms of service and privacy policy [https://stripe.com/legal] for information on its use and storage of User Content. By providing us with any personal information, you represent that you are the owner of such personal information or otherwise have the requisite consent to provide it to us.

When you send us User Content (including, but not limited to, pictures, text, documents, and video) for the purposes of performing the Services.

The Services use cookies and similar technologies such as pixel tags, web beacons, clear GIFs, mobile identifiers, and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser. We only use cookies for functions essential to performing the Services, such as tracking user sessions in the SmartLens Dashboard.

How do we use the data we collect?

To provide, operate, maintain, and/or improve the Services for all users of the Services.

To enable you to access and use the and Services.

To provide customer service and support and send you technical notices, updates, security alerts, and support and administrative messages.

What security precautions does SmartLens take?

The security of your User Content is important to us. We take all reasonable steps to protect information we receive from you from loss, misuse or unauthorized access, and/or disclosure. We have put in place appropriate physical, technical and administrative measures to safeguard and secure your information, and we make use of privacy-enhancing technologies such as end-to-end encryption.

What should EU and UK residents know?

Please note that the User Content referenced in this Privacy Policy means “personal data” as that term is defined under the European Union (“EU”) General Data Protection Regulations (“GDPR”) and its United Kingdom (“UK”) GDPR counterpart. SmartLens is a data controller for the Personal Data collected from all categories of User Content listed above except for payment information, for which Stripe, Inc. is a data processor. If you are an individual from the European Economic Area (the “EEA”), the UK or Switzerland, please note that our legal basis for collecting and using your personal information will depend on the personal information collected and the specific context in which we collect it. We normally will collect personal information from you only where: (a) we have your consent to do so, (b) where we need your personal information to perform a contract with you (e.g. to deliver the Services you have requested), or (c) where the processing is in our legitimate interests. Please note that in most cases, if you do not provide the requested information, SmartLens will not be able to provide the requested service to you. In some cases, we may also have a legal obligation to collect personal information from you, or may otherwise need the personal information to protect your vital interests or those of another person. Where we rely on your consent to process your personal data, you have the right to withdraw or decline consent at any time. Where we rely on our legitimate interests to process your personal data, you have the right to object.
